Invention Patent

Duration:
Twenty (20) years from the filing date.

Laid-open Date:
Application is obligated to be published after 18 months from the filing date.

Examination:
Request for substantive examination has to be filed within three years from the filing date.

Maintenance Fee:
The maintenance fee shall be paid from the beginning of the 3rd year to keep patent application in force till granted.

Annuity:
Annuity shall be paid annually after registration.

Publication:
Application is proceeded to publish after registration.

To initiate a patent application in China, you should at least provide:
1. A copy of description, claims, abstract, and formal drawings (or photographs).
2. The name and address of the inventor/applicant.
3. The date and number of priority and the name of the country in which the application has been first filed (if priority right is claimed).

Following documents could be submitted within 3 months from the filing date:
4. An original inventor-signed Assignment if the inventor is not the applicant.
5. An original applicant-signed Power of Attorney.
6. A certified copy of the priority document if priority would be claimed.

Official Fee for Patent Application

Note:
1. USD 37 of maintenance fees shall be paid annually from the third year of application till granted.
